Lessor resources

The Lease Contract Administration (LCA) team processes real estate taxes, operating cost adjustments, step rents (rent adjustments), and changes of ownership/novations for all GSA leases. The LCA team also conducts annual audits of each lease file to ensure lease language is correctly reflected in our financial systems so we know we are paying lessors accurately and timely.

The team is divided into 3 Zonal teams who serve all 11 GSA Regions.

Changes of ownership (novation)

FAR 42.1204 provides a framework for the government to recognize a change of ownership (i.e., when a lessor buys or sells a property where a government tenant resides). You may use the Sample Novation Agreement for GSA’s Leases [PDF - 366 KB] for reference to transfer ownership.

  1. PAYMENT: The current contract terms do not change and we will continue to pay the current lessor until the lease is amended to recognize the new owner as the lessor.
  2. PREPARATION:Start the process early—the standard Change of Ownership clause requires the lessor to inform us within 5 days of transfer of title.
  3. PROCESS: The seller must maintain its System for Award Management (SAM) registration. The buyer must provide proof of active SAM registration for All Awards for the Novation to be completed.

Traveler reimbursement is based on the location of the work activities and not the accommodations, unless lodging is not available at the work activity, then the agency may authorize the rate where lodging is obtained.

Unless otherwise specified, the per diem locality is defined as "all locations within, or entirely surrounded by, the corporate limits of the key city, including independent entities located within those boundaries."

Per diem localities with county definitions shall include"all locations within, or entirely surrounded by, the corporate limits of the key city as well as the boundaries of the listed counties, including independent entities located within the boundaries of the key city and the listed counties (unless otherwise listed separately)."

When a military installation or Government - related facility(whether or not specifically named) is located partially within more than one city or county boundary, the applicable per diem rate for the entire installation or facility is the higher of the rates which apply to the cities and / or counties, even though part(s) of such activities may be located outside the defined per diem locality.
